Terms and Conditions for EV-appliance service LLC
1. General Provisions 1.1. These Terms and Conditions (hereinafter referred to as "Terms") govern the use of services provided by EV-appliance service LLC (hereinafter referred to as the "Company") and establish the rights and obligations of the parties. 1.2. By ordering the Company's services, the Client agrees to these Terms.
2. Services 2.1. The Company provides repair services for household appliances, including but not limited to: refrigerators, freezers, washing machines, dryers, and dishwashers. 2.2. Services are provided based on availability and by appointment.
3. Who Can Use Our Services 3.1. To use our services, you must be at least 18 years old or have reached the age of majority in your jurisdiction and have the legal authority, right, and freedom to enter into these Terms as a binding agreement. 3.2. The Company's services are provided within the territory defined by the Company.
4. Key Commercial Terms 4.1. When ordering services, the Client agrees that: (i) they are responsible for providing accurate information about the malfunction; (ii) they enter into a legally binding contract for the provision of services when placing an order. 4.2. The prices for services are listed on the Company's website and may be changed without prior notice. 4.3. 5. Return and Refund Policy 5.1. The Client is entitled to a refund if the services were not provided or were provided improperly. 5.2. For any undamaged equipment that cannot be repaired, the Company will offer a refund based on the original payment method.
6. Right to Modify the Offer 6.1. The Company may change services, discontinue providing services, or any features of the offered services without prior notice.
7. Warranties and Liability for Services 7.1. The Company provides a 30-day warranty on the performed work from the date of service. 7.2. When the Company receives a valid warranty claim, it will either repair the corresponding defect or offer a refund upon the return of the equipment.
8. Intellectual Property Rights 8.1. All content, materials, and products of the Company are the exclusive property of the Company. No rights to use such materials are granted to the Client, except as provided in these Terms.
9. Right to Suspend or Cancel Services 9.1. The Company may temporarily or permanently discontinue providing services without notice and liability for any reason, including violation of these Terms. 9.2. The Client may discontinue using the Company's services at any time.
10. Indemnification 10.1. The Client agrees to indemnify and hold the Company harmless from any claims, losses, liabilities, demands, or expenses, including attorney's fees, made by any third party due to or arising out of the Client's use of the Company's services.
11. Limitation of Liability 11.1. To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the use of the services. 11.2. The Company shall not be liable for any errors, mistakes, or inaccuracies of information provided.
12. Right to Change and Modify Terms 12.1. The Company reserves the right to change these Terms from time to time at its sole discretion. Clients are advised to review this page periodically.
13. Promotional Messages and Content 13.1. The Client agrees to receive promotional messages and materials from the Company by mail or email. The Client may opt-out of receiving such materials at any time.
14. Governing Law and Dispute Resolution 14.1. These Terms are governed by and construed in accordance with the laws of the state of Hawaii, USA. Any disputes shall be resolved in the courts located in the city of Honolulu.
